Policy: Consulting or Outside Employment
Employees may engage in consulting or other employment and business activities outside Laboratory hours and away from the Laboratory as long as such activities do not interfere with performance of their Laboratory duties or create a real or apparent conflict of interest. The following essential points should be noted:
- When a scientific or technical consulting or employment agreement is offered to any Lab employee (including Faculty Scientists), the proposed agreement requires Lab management review and approval before execution of the agreement by the employee.
- To request approval for engaging in outside consulting or employment, LBNL employees and scientists must complete the form, Request to Engage in Compensated Outside Professional Activities, which will require the signatures of the employee’s supervisor and Division Director. Submit the completed form and a copy of the proposed agreement to the Conflict of Interest Coordinator (x4453; MS 50A-4112) and the Tech Transfer Patent Group (x7058; MS 56A-0120) for their review.
- To comply with the terms of the University/Department of Energy Contract, the agreement may require specific language concerning University of California property and patent rights in order to obtain Laboratory approval. That language can be found at RPM 10.02 I.
- Questions on inventions and patent articles in a proposed consulting agreement should be directed to Technology Transfer (x7058; ttd@lbl.gov).
RPM 10.02 provides more detail on issues related to working for an outside organization.
